For this reason, we encourage you to review the Agreement whenever you use any of the Sites. If you do not agree to these terms, please do not use the Sites.

 

The Sites Transactions

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event we make a change to or cancel an order, we will attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers, distributors or diverters.

The Sites and the Contents are intended solely for personal, non-commercial use. You may not reproduce (except as noted above), publish, transmit, distribute, display, modify, create derivative works from, sell or exploit in any way any of the Contents or the Sites.

Unless otherwise specified, the Sites and the Contents are intended to promote Hom’s products and services available in the United States. The Sites are controlled and operated by Hom from its offices at 20703 Wendy Drive, Torrance CA 90503. One or more patents may apply to the Sites.

The content on the Sites does not constitute medical or any other form of professional advice. User Comments, Feedback, and Other Submissions

Hom is pleased to hear from users and welcomes your comments regarding our products and services. Hom’s longstanding policy does not allow us to accept or to consider creative ideas, suggestions, proposals, plans, or other materials other than those we have specifically requested. We hope that you will understand that the intent of this policy is to avoid the possibility of future misunderstandings when projects developed by Hom’s employees and agents might seem to be similar to creative works submitted by users. Accordingly, while we value your feedback, we must ask that you do not send creative ideas, suggestions, proposals, plans, or other materials for our business. If, at our request, you send certain specific submissions (for example contest entries) or without out a request from us you send creative ideas, suggestions, proposals, plans, or other materials, whether online, by email, by postal mail, or otherwise (collectively, "Comments"), you agree that Hom may, at any time, without restriction, edit, copy, publish, distribute, translate, and otherwise use in any medium any Comments that you forward to Hom and Hom shall be under no obligation (1) to maintain any Comments in confidence; (2) to pay compensation for any Comments; or (3) to respond to any Comments. Hom has the right but not the obligation to monitor and edit or remove any Comments.

You agree that your Comments will not violate any right of any third party, including copyright, trademark, privacy or other personal or proprietary right. You further agree that your Comments will not contain libelous or otherwise unlawful, abusive or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the Site. You may not use a false e-mail address, pretend to be someone other than yourself, or otherwise mislead Hom or third parties as to the origin of any Comments. You are solely responsible for any Comments you make and their accuracy. Hom takes no responsibility and assumes no liability for any Comments posted by you or any third party.

Hom respects the intellectual property of others. If you believe that your work has been copied in any way that constitutes copyright infringement, please send an email directly to hello@homsweethom.com. Hom maintains, where required by law, a Digital Millennium Copyright Act that Hom may publish from time-to-time.

 

Product Information

Many products displayed on the Sites are or may become available in select retail stores in the United States and, in some cases, select foreign markets. The prices displayed on the Sites are quoted in U.S. Dollars.

Certain products are available exclusively online through the Sites. These products may have limited quantities and are subject to return or exchange only through the Sites according to the applicable return policy. 

 

Errors, Inaccuracies, and Omissions

Occasionally there may be information on our Sites that contains typographical errors, inaccuracies, or omissions that may relate to product descriptions, pricing, promotions, offers, and availability. We reserve the right to correct any errors, inaccuracies or omissions and to change or update information or cancel orders if any information on the Sites is inaccurate at any time without prior notice (including after you have submitted your order).

Hom expressly disclaims any duty to update or revise the materials on the Sites, although Hom may modify the materials at any time without notice. Your use of the Sites is at your sole risk, and you assume full responsibility for any costs associated with your use of the Sites. Indemnification

You agree to defend, indemnify and hold Hom harmless from and against any and all claims, damages, costs and expenses, including attorneys' fees, arising from or related to your use of the Sites and/or your breach of any representation, warranty, or other provision of the Agreement.

 

Dispute Resolution

Mindful of the high cost of litigation, not only in dollars but also in time and energy, both you and Hom agree to the following dispute resolution procedure: In the event of any controversy, claim, action or dispute arising out of or related to any transaction conducted on the Sites, or the breach, enforcement, interpretation, or validity of this Agreement or any part of it ("Dispute"), the party asserting the Dispute shall first try in good faith to settle such Dispute by providing written notice to the other party (by first class or registered mail) describing the facts and circumstances (including any relevant documentation) of the Dispute and allowing the receiving party 30 days in which to respond to or settle the Dispute. Notice shall be sent:

(2) to you at: your last-used billing address or the billing and/or shipping address in your online profile. 

Both you and Hom agree that this dispute resolution procedure is a condition precedent which must be satisfied prior to initiating any litigation or filing any claim against the other party.

 

Choice of Law

This Agreement shall be construed in accordance with the laws of the State of California, without regard to any conflict of law provisions. Any dispute arising under this Agreement shall be resolved exclusively by the state and/or federal courts of the State of California, County of Los Angeles and/or the Central District of California. The waiver of any provision of the Agreement shall not be considered a waiver of any other provision or Hom’s right to require strict observance of each of the terms herein. If any provision of the Agreement is found to be unenforceable or invalid for any reason, that provision shall be severable, and all other provisions shall remain in full force and effect. This Agreement constitutes the entire agreement between us relating to your use of the Sites.

We collect information from you in several different ways on the Sites. One goal in collecting personal information from you is to provide an efficient, meaningful, and customized experience. For example, we can use your personal information to:

  • help us create content on the Sites that is most relevant to you.

Registration and Ordering. Before using certain parts of the Sites or ordering products, you must complete online registration. Email Addresses. Several locations of the Sites permit you to enter your email address for purposes including but not limited to: to register for classes; to request us to notify you when we offer a new products, to contact Hom and to sign up for our email newsletter. 

Cookies and Other Technology. Like many sites, the Sites employs cookies and web beacons (also known as clear GIF technology or "action tags") to speed your navigation of the Sites, recognize you and your access privileges, and track your usage on the Sites.

Cookies are small pieces of information that are stored as text files by your Internet browser on your computer's hard drive. Most Internet browsers are initially set to accept cookies. You can set your browser to refuse cookies from web sites or to remove cookies from your hard drive, but if you do, you will not be able to access or use portions of this Site. Age. We respect children's privacy. We do not knowingly or intentionally collect personal information from children under age 15. Elsewhere on this Site, you have represented and warranted that you are either 18 years of age or using the Site with the supervision of a parent or guardian. If you are under the age of 15, please do not submit any personal information to us, and rely on a parent or guardian to assist you.

Product/Class/Design Reviews. You may choose to submit a product/class/design reviews. If you post a review, we may ask for your email address and geographic location. If you submit a review, your geographic location may be visible to other users (your email address will be kept private). Also, any personally identifiable information that you submit as part of the review can be read or used by other visitors to the Sites. We are not responsible for any personally identifiable information that you choose to submit as part of your review. We believe you can post a helpful review without disclosing any personal information.

 

INFORMATION USE AND DISCLOSURE

Internal Use. We use your personal information to process your order and provide you with customer service. We partner with third parties (such as the U.S. Postal Service, United Parcel Service, and Federal Express) to ship products, to ensure delivery, and so that we can obtain feedback, improve the quality of our service, and measure and improve the quality of the service of the third party. In the example of shippers, we provide them some personally identifiable information such as your name, shipping address, email, and phone number.

DATA SECURITY

The Sites incorporates physical, electronic, and administrative procedures to safeguard the confidentiality of your personal information, including Secure Sockets Layer ("SSL") for all financial transactions provided by third party providers through the Sites. Finally, we rely on third-party service providers for the physical security of some of our computer hardware. We believe that their security procedures are adequate. For example, when you visit the Sites, you access servers that are kept in a secure physical environment, behind a locked cage and an electronic firewall. While we use industry-standard precautions to safeguard your personal information, we cannot guarantee complete security. 100% complete security does not presently exist anywhere online or offline.

 

OPT OUT/CORRECTIONS

Upon your request, we will (a) correct or update your personal information; (b) stop sending emails to your email address; and/or (c) disable your account to prevent any future purchases through that account. OFFLINE COLLECTION, USE & DISCLOSURE OF INFORMATION

As you might expect from Hom, the majority of information that we collect is obtained through the Sites, and this Privacy Policy applies only to that online collection of personal information. We also collect information offline, where we also try to protect the privacy of your personal information. One example involves someone calling us to place an order. Register for a class or to ask questions. When someone calls, we will ask only for the personal information we need in order to place the order or to answer the question. When we need to store information (such as order information), we will enter it into our database through SSL encryption. (See the Data Security section above for more information). There are other ways we could learn of personal information offline (for example, we suppose someone could send us a letter including some return address information), and this Policy doesn't discuss or try to predict all of those methods or uses.
